Manual Reference:  Section 3345 and 3350

All TANF/FS applicants/recipients must participate in the work program unless exempt.  Any individual referred to TANF is considered to have met FS work requirements.

FS EXEMPTIONS
Child under 16

Child 16-17 in school at least half time

Person 60 or older
Student enrolled at least half time (must meet student criteria) see the policy manual section 3245
Caretaker of a dependent child under 6
Caretaker needed on a substantially continuous basis to care for another individual due to mental or physical impairment

Does not need to be AU member or in the home

A person is physically or mentally incapacitated if one of the following descriptions applies:
  • temporarily ill/unfit for employment based on medical verification (Pregnancy is considered as unfitness for employment. Pregnancy must be verified by a medical statement.)
  • temporarily ill/unfit for employment based on worker observation
  • receiving disability benefits (SSI, RSDI, 100% VA, Railroad Retirement, Worker's Compensation, etc.)
  • has an application pending for SSI
Person is working (includes self-employment) an average of 30 hours a week, or earning weekly the equivalent of 30 hours at minimum wage
Seasonal farm worker who is under contract to begin work within 30 days
VISTA volunteer
Participant in a drug/alcohol treatment center
Receiving or applied for UCB
Remember, an individual who is referred for TANF work requirements is considered to have met FS work requirements and must be be coded as "exempt for FS as complying with TANF."
